   We use Personal Information to facilitate your use of the Services, to process your requests or transactions, to provide you with information, products and services you request, to administer and assist us with the operation of our business, and for the purpose for which the information was provided. We may use the information we collect to send you news relevant to you or in accordance with your preferences. We may also send you advertisements from third parties. We do not disclose, rent, sell or otherwise make available your Personal Information to third parties for direct marketing purposes. We may also send you marketing emails & text/ Whatsapp messages to inform you about new features, offers, etc.

4. Publicly Posted Information

   Personal Information that you post to public areas of the Services or via your Profile may become publicly available and is no longer considered Personal Information. For example, information you post in your Profile or any other interactive areas may be made publicly available and can potentially be viewed by anyone. Your posting to such public areas of the Services constitutes consent to share such information publicly, and you should assume that such information will be widely disseminated, including via search engines and other tools to locate information online (e.g., internet archive).

   We do not ordinarily send text messages for marketing purposes, but to the extent you provide us with your mobile telephone number, you consent to the transmission of text messages to such number, and waive any rights you may have under the Indian laws. FirstCut endeavours to secure your Personal Information from unauthorized access, use or disclosure by putting into place reasonable physical, electronic and managerial procedures to safeguard the information we collect. However, no security measures are perfect or impenetrable. To protect the confidentiality of your Personal Information, you must keep your password confidential and not disclose it to any other person. You are responsible for all use of the Services by any person using your password. Please advise us immediately by emailing us if you believe your password has been misused. You should also note that email is not secure, and you should not send any confidential or sensitive information to us via an unsecured email.

THIRD PARTY WEBSITES AND PRACTICES

The Services may contain links to other websites or make available third party services, including ad platforms and technologies. We are not responsible for the privacy practices of such third parties. We encourage you to be aware and to read the privacy policies of any website or service that collects your information. Similarly, if you accessed the Services through another website, we are not responsible for the privacy practices of that website, and you should review the privacy policy of the originating website before providing any information to that website. This Policy applies solely to information collected by us.

TRANSFERS OF INFORMATION

Information about our customers, including Personal Information, may be disclosed as part of any merger, acquisition, debt financing, sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which Personal Information could be transferred to third parties as one of FirstCut business assets. In such an event, we will attempt to notify you before your Personal Information is transferred, but you may not have the right to opt out of any such transfer.

Minor's Policy:

Eligibility and Age Restriction

Minors i.e., any person under the age of 18 years can register on the FirstCut app only with the involvement & permission of a parent or legal guardian. In the event of a minor using or registering with the app, responsibility or liability for the minor's action shall be on his or her parent or legal guardian. The parent/legal guardian bears full responsibility in case of any legal compliance

How We Gather Parent / Guardian's Consent:

During the signup process, when a user selects that he/she is below 18 years of age, we ask them to furnish the following information - Parent's/ Legal Guardian's Name, Email Address, Mobile Number, DOB and identity proof such as License, Aadhar Card, Pan Card, Voter Card etc.

An OTP is sent to both the mobile & email id of the Parent / Legal Guardian. As soon as the Email/ Mobile is verified, an email is sent to the parent's/ legal guardian's email address asking for their consent. The Minor's account will remain inactive till the time the consent is not provided via the email.

Information that we collect:

It's important to note what personal information we collect in association with your child’s FirstCut account, why we collect it and how you can update, manage and delete that information.

We collect:

• Information that you and your child create or provide us with such as portfolio pictures and audition videos.
• As part of the account creation process, we ask for personal information such as first name and surname, email address, date of birth etc. For users under 18 years of age, we ask to furnish the following information such as Parent's/ Legal Guardian's Name, Email Address, Mobile Number, DOB and identity proof such as License, Aadhar Card, Pan Card, Voter Card etc. An OTP is sent to both the mobile & email id of the Parent / Legal Guardian. As soon as the Email/ Mobile is verified, an email is sent to the parent's/ legal guardian's email address asking for their consent. The Minor's account will remain inactive till the time the consent is not provided via the email.
• After the account is active, we also ask for physical details like weight, height, complexion and other body statistics which are required to match your child’s profile to the relevant audition requirements. However, this information is optional.
• An option has been provided to parents or guardians to delete his/her minor child's account within the app. An OTP will be sent to the Parent's mobile/email id for verification and once verified the account will be deleted.

How we use the information that we collect

FirstCut's Privacy Policy explains in greater detail the purposes for which it collects data in association with your child’s account. In general, we use your child’s information: to provide and maintain our services, to recommend relevant audition opportunities for them in Acting, singing, modeling or dancing ; to customize our services for your child; to measure performance and understand how our services are used; to communicate directly with your child in relation to our services; and to help improve the safety and reliability of our services. We may use your child’s information to provide promotional information, recommendations and customized search results.

All references to “you” or “your”, as applicable, mean the person that accesses, uses or participates in the Platform in any manner (i.e., the Model, Actor, Modelling Agency or Production House). If you use the Platform or open an Account (as defined below) on behalf of a business (i.e., a Production House or Modelling Agency), you represent and warrant that you have the authority to bind that business and your acceptance of the Terms of Use will be deemed an acceptance by that business and “you” and “your” shall refer to that business.
